These terms and conditions apply to all offers, orders, agreements, and purchases made through the Zynvela website.

By placing an order, you declare that you agree to these terms and conditions.

2. Applicability

These terms and conditions apply to every offer made by Zynvela and to every agreement formed between Zynvela and the customer.

Deviations are only valid when agreed with Zynvela in writing.

3. Offer and product information

We do our best to display all products, prices, colors, sizes, images, and descriptions as accurately as possible.

Minor variations may occur, for example due to:

• screen settings;

• lighting conditions;

• production batches;

• manual measurements;

• supplier updates.

Obvious errors, typos, and mistakes are not binding.

4. Formation of the agreement

The agreement is formed when:

• the customer has placed an order;

• payment has been successfully completed;

• Zynvela has confirmed the order.

Zynvela reserves the right to refuse or cancel an order, for example in the case of:

• an obvious pricing error;

• suspected fraud;

• incorrect customer details;

• an unavailable product;

• technical issues.

When a paid order is cancelled by us, the amount paid will be refunded.

5. Prices and payment

All prices are displayed in euros (€).

When an order is shipped directly from outside the European Union under DAP (Delivered At Place – Incoterms® 2020), any import VAT, customs duties, clearance costs, and other import-related costs are not included in the product price or shipping costs, unless expressly stated otherwise.

Any shipping costs are displayed at checkout.

The customer is responsible for providing correct payment and billing details.

6. Delivery

Estimated processing times and delivery times are stated in our shipping and delivery policy.

The delivery times mentioned are indicative and may change due to circumstances beyond our control.

The customer is responsible for providing a complete and correct delivery address.

7. Right of withdrawal and returns

The terms and instructions for returns are described in our return policy.

The customer must submit a return request within the specified return period.

The direct costs of returning items are the responsibility of the customer, unless otherwise agreed or legally required.

8. Complaints

Please check your order as soon as possible after receiving it.

Complaints about a damaged, defective, or incorrectly delivered product must be reported to us as soon as possible.

Please include your order number and, where relevant, clear photos or videos.

We aim to respond substantively within 5 business days.

9. Liability

Zynvela is not liable for damage resulting from:

• incorrect use of a product;

• failure to follow product or care instructions;

• incorrect information provided by the customer;

• delays or events beyond our reasonable control.

Our liability is, to the extent permitted by law, limited to the amount paid for the relevant order.

This limitation does not apply where liability may not be excluded or limited under mandatory law.

10. Force majeure

Zynvela is not responsible for delay or failure to fulfill obligations as a result of force majeure.

Force majeure includes, among other things:

• natural disasters;

• war;

• strikes;

• epidemics or pandemics;

• carrier disruptions;

• government measures;

• internet or power outages;

• supplier issues;

• other circumstances beyond our reasonable control.

11. Intellectual property

All content on our website, including text, images, logos, designs, product names, and graphic elements, is owned by Zynvela or used with permission.

This content may not be copied, distributed, modified, or used commercially without prior written consent.

We process personal data in accordance with our privacy policy and applicable privacy law.

Zynvela may amend these terms and conditions.

The terms in effect on the website at the time an order is placed apply to that order.

14. Governing law

Agreements with Zynvela are governed by Dutch law, unless mandatory consumer law provides otherwise.

Disputes are preferably resolved through mutual consultation first.

15. International delivery, import VAT, and import costs

Orders may be shipped to the customer directly from a country outside the European Union.

When an order is shipped to the customer directly from outside the European Union, delivery takes place under DAP (Delivered At Place, formerly also referred to as DDU). This means Zynvela arranges for the order to be shipped to the delivery address provided by the customer, but the customer, as consignee/importer, is responsible for importing the product.

Additional costs may be charged upon import or delivery by the carrier, postal service, customs, or relevant authority. These may include, among others:

import VAT;
customs duties;
clearance costs;
administrative fees;
other import-related costs.

These costs are the responsibility of the customer as consignee/importer and are not included in the product price or shipping costs, unless expressly stated otherwise.

When delivery takes place under DAP, no EU VAT is charged on the sale by Zynvela. Any import VAT and other import-related costs are paid by the customer, as consignee/importer, upon import.

Zynvela does not pay, advance, or guarantee import VAT, customs duties, clearance costs, or other import-related costs on behalf of the customer.

For orders delivered under DAP, no use is made of IOSS or a similar scheme under which import VAT is remitted in advance by or on behalf of Zynvela.

When the customer refuses to pay any import VAT, customs duties, clearance costs, or other import-related costs, this may affect delivery of the order. Any delays, returns, or additional costs resulting from this are at the customer's expense and risk, to the extent permitted by law.

In the event of a return, refusal, or non-delivery, any import VAT, customs duties, clearance costs, administrative fees, or other import-related costs paid by the customer will not be refunded by Zynvela. For any reimbursement of such costs, the customer should contact the carrier, customs, or the relevant authority directly.

This article does not affect the customer's statutory rights, including the right of withdrawal, warranty, and other mandatory consumer rights.
